Blooming Villa Higashikawa Rental Agreement
By clicking “Reserve” on the Reservation page the lessee is accepting these terms and conditions.
Your agreement is with the owner (“we”, “us” and “our” in these Terms and Conditions) for the property of Blooming Villa Higashikawa. References to “you” or “your” are references to the lessee, which includes the person making the booking and all members of the holiday group staying at the property.
Arrival time: 15:00 – 17:00
Departure time: 10:00
* If you need to check in or check out earlier or later than these times, let us know in advance and we will make alternative arrangements.
Reservation & Security Deposit
1.1. The minimum age required to make a reservation is 25 or older.
1.2 A reservation is not confirmed until payment is received and a confirmation issued by us.
1.3. Payment of 100% of the fee is required to confirm the reservation.
1.4. Descriptions and details of our services are subject to change at any time.
1.5 Security/Damage Deposit: A refundable security/damage deposit of 25,000JPY is required. You will be asked to authorize a hold for this amount on your credit card at the time of check-in. The hold will be released within 3 days after departure provided the property is left in good condition. The cost of repairing any damage will be deducted from the deposit. In case of major damage, you may be liable for additional charges.
Prices
2.1. All prices are in Japanese Yen and include Japanese consumption tax.
2.2. We reserve the right to correct any accommodation or guest services rates that may have been misquoted due to human and/or computer error.
2.3. All offers, prices, terms and conditions are subject to change or withdrawal without notice prior to a confirmation being issued.
Payment
3.1. We accept payments in Japanese Yen, including via credit card or any other method accepted by our payment processor, Stripe.
3.2. Where the currency of your credit card is not Japanese Yen:
3.2.1. All foreign exchange rate calculations and charges are your responsibility.
3.2.2. There may be differences between the date of your credit card payment, the date the charges appear on your credit card statement, and the date on which the currency calculation is made.
3.2.3. Where we cancel, void or refund a payment to your credit card in JPY, there will be changes in the refund amount due to foreign currency exchange rates and fees and charges of your bank or credit card company; any differences are your responsibility.
Cancellation Policy
4.1. To cancel your reservation, reply to the email you received confirming your reservation.
4.2. If the cancellation is received 14 days or more before your check-in date, 100% of your payment will be refunded. *A transaction processing fee of between 2.9% and 3.9% depending on your location will be deducted from the refund.
4.3. If the cancellation is received between 14 days and 7 days before your check-in date, 50% of your payment will be refunded. *A transaction processing fee of between 2.9% and 3.9% depending on your location will be deducted from the refund.
4.4. If the cancellation is received within 24 hours of booking and the cancellation occurs at least 7 days before check-in, 100% of your payment will be refunded. *A transaction processing fee of between 2.9% and 3.9% depending on your location will be deducted from the refund.
4.5. If your stay is canceled or interrupted due to unforeseen problems with the building (water, electricity, etc.), you will only be charged for the length of your stay up to that point.
House Rules
5.1. No smoking or vaping of any type is permitted in the house or on the property. The house is inspected immediately upon checkout and any additional cleaning required as a consequence of smoking will result in the forfeiture of the security deposit. You may also be charged for any costs incurred in compensating future guests who are affected by the smell, or for bookings that need to be relocated to a different property as a result.
5.2. You are responsible for the actions of any other person on the rental premises. Only registered guests included on the reservation are permitted to stay. Please ensure that the correct number of guests is reflected in your reservation.
5.3. Outdoor equipment is not allowed in the house, other than in the storage room to the left of the entrance. Guests are solely responsible for the security of their items on the premises.
5.4. No pets are allowed on the property, either inside or outside.
5.5. You must inform us of any damage or breakage caused during the stay.
5.6. You are liable for material damage to the house or property during the rental period for any cause whatsoever, other than damages resulting from construction defects, lack of maintenance, natural and technological disasters.
5.7. You agree to respect the rental premises and leave them in the same condition as when they were rented. Furniture and objects for your use must be handled with care and used only for the purposes for which they are intended.
5.8. If cleaning takes longer than the standard time due to the accommodation being left in an excessively dirty state, additional cleaning charges may apply.
5.9. You agree to respect the property of neighbors and other residents.
5.10. Any defects noted by you during the rental period should be reported immediately.
5.11. Guests should not participate in film or photography of the house or property that is intended for commercial use or profit, without documented permission from the host.
Important Conditions
6.1. The Residence unit has a maximum capacity of 4 people. The Studio unit has a maximum capacity of 3 people – up to 2 adults and 1 child to age 12. The maximum number of Guests per accommodation may not be exceeded.
6.2. You may not transfer the rights under this rental agreement or sublet the unit.
6.3. If, on the date of departure, you do not leave by the time stipulated in the agreement, additional charges may apply.
6.4. The entrance doors to the units operate via a touchless smart key system. If any of the keys are lost, they will need to be replaced and the cost of this replacement will be charged to you.
6.5. Japanese Law requires that we obtain names, addresses, and contact details for all guests, plus a photocopy of all passports for all foreigners over the age of 18 not residing in Japan. This information is requested via the reservation form at the time of booking.
6.6. For foreign residents of Japan and Japanese nationals, all persons over the age of 18 will be required to present a photo ID at the time of check-in.
Parking
7.1 Parking during winter months will be restricted due to snow conditions. If your group requires parking for more than 2 vehicles please confirm the availability of parking with us at the time of reservation.
7.2 Parking on the road is illegal and your car may be towed.
Checkout
The following checkout requirements need to be adhered to in order to avoid additional cleaning charges (see 5.8).
8.1 Please leave the house in good condition and return any moved items back to their original location.
8.2 Place all waste in the rubbish bins provided.
8.3 Discard any food you are not taking with you.
8.4 Wash any dirty dishes before leaving, or place them in the dishwasher.
8.5 Place all used bath towels, hand towels, etc. by the washing machine.
8.6 Ensure all windows and doors are locked.
8.7 Return all keys to the checkout staff, or follow the instructions provided if you have requested an alternative checkout time. As above, you will be charged to replace any keys that are not returned.
General Provisions
9.1 This short-term rental agreement may be amended only in writing.
9.2 Even if any provision in this agreement is deemed null and void, the other agreement provisions remain valid. The parties must come to an agreement reflecting as much as possible the economic objectives of the two parties to this agreement in order to replace the provision deemed null and void.
9.3 This Agreement will be governed by and construed in accordance with the laws in force in Hokkaido and Japan.
9.4 We affirm that the facility holds a valid lodging certificate issued by the Kamikawa Public Health Administration in accordance with Hokkaido Ryokan Business Law.
9.5 We may not be held liable for any accident, injury, or illness that is your fault, and that may befall you during the stay. By accepting this provision, you accept the risks associated with your stay at the establishment.
9.6 We may not be held liable for the theft or loss of your property during your stay.
9.7 We are happy to host families with infants and children, but the property has not been specifically child-proofed. There is a flight of stairs as can be seen in the photos and the property entrance leading to the road is not gated, so please take that into account.
9.8 Shoes: No shoes are to be worn inside the house, other than on the tiles in the entrance area, and inside the storage room beside the entrance.
9.9 Snow: While built-up snow on the property will be removed periodically during winter, there are areas the snow plough cannot reach, particularly close to the entrances. Depending on the weather conditions, there may be snow in certain places deep enough to cover your footwear.
9.10 There are motion-sensor security cameras affixed to the outside of the house for your personal safety and the security of the property.
